（一）发生危及旅游者人身安全的情形，未采取必要的处置措施并及时报告的；
（二）旅行社组织出境旅游的旅游者非法滞留境外，旅行社未及时报告并协助提供非法滞留者信息的；
（三）旅行社接待入境旅游的旅游者非法滞留境内，旅行社未及时报告并协助提供非法滞留者信息的。
第六十四条 因妨害国（边）境管理受到刑事处罚的，在刑罚执行完毕之日起五年内不得从事旅行社业务经营活动；旅行社被吊销旅行社业务经营许可的，其主要负责人在旅行社业务经营许可被吊销之日起五年内不得担任任何旅行社的主要负责人。
第六十五条 旅行社违反本条例的规定，损害旅游者合法权益的，应当承担相应的民事责任；构成犯罪的，依法追究刑事责任。
第六十六条 违反本条例的规定，旅游行政管理部门或者其他有关部门及其工作人员有下列情形之一的，对直接负责的主管人员和其他直接责任人员依法给予处分：
（一）发现违法行为不及时予以处理的；
（二）未及时公告对旅行社的监督检查情况的；
（三）未及时处理旅游者投诉并将调查处理的有关情况告知旅游者的；
（四）接受旅行社的馈赠的；
（五）参加由旅行社支付费用的购物活动或者游览项目的；
（六）通过旅行社为自己、亲友或者其他个人、组织牟取私利的。
第七章 附 则
第六十七条 香港特别行政区、澳门特别行政区和台湾地区的投资者在内地投资设立的旅行社，参照适用本条例。
第六十八条 本条例自2009年5月1日起施行。1996年10月15日国务院发布的《旅行社管理条例》同时废止。
