第七章法律责任
第五十五条 违反本条例条二十九条第二款规定的，由旅游行政主管部门责令改正，没收违法所得，可以并处二千元以上一万元以下罚款。
第五十六条 违反本条例第三十六条规定的，由旅游行政主管部门责令改正，没收违法所得，可以并处五十元以上二百元以下罚款。
第五十七条 违反本条例第三十九条第一款规定未佩戴导游证的，由旅游行政主管部门责令改正，拒不改正的，处五百元以下罚款。
违反本条例第三十九条第二款规定的，由旅游行政主管部门责令改正并予以公告，没收违法所得，并处一千元以上三万元以下罚款。
第五十八条 违反本条例第四十一条第二款、第四十二条、第四十五条、第四十六条规定的，由旅游行政主管部门责令改正，可以并处一千元以上一万元以下罚款；情节严重的，处一万元以上三万元以下罚款。
第五十九条 旅游行政主管部门作出对个人处三千元以上罚款、对单位处二万元以上罚款处罚决定的，应当告知当事人有要求听证的权利。
第六十条 违反本条例规定的其他行为，法律、法规有处罚规定的，从其规定。
第六十一条 旅游行政主管部门直接负责的主管人员和其他直接负责人员在工作中，滥用职权、玩忽职守、徇私舞弊的，由其所在单位或者上级主管部门依法给予行政处分；构成犯罪的，依法追究刑事责任。
第八章附则
第六十二条 本条例自 2005年 12月 1日起施行。 1998年 8月 22日陕西省第九届人民代表大会常务委员会第四次会议通过的《陕西省旅游管理条例》同时废止。
