行政处罚案件调查终结，承办人应制作《行政处罚案件调查终结报告》（附件），报稽查队领导作出批示；经调查不构成行政处罚的由承办人填写《行政处罚案件撤销立案报告》（附件），经领导审批后制作《行政处罚案件撤销立案通知书》（附件）并送达当事人；如构成行政处罚时，由案件承办人制作《行政处罚呈批报告》（附件），报领导审批。
五、事前告知
对当事人作出行政处罚决定前，应告知其有陈述和申辩的权利，由承办人制作《行政处罚事先告知书》（附件），经领导审核后送达当事人。《行政处罚事先告知书》给予当事人陈述和申辩的准备时间不少于10个工作日。对当事人提出的事实理由或证据成立的应采纳。
六、听证
对当事人作出责令停业，吊销许可证或较大数额罚款等行政处罚决定前，应当告知当事人有听证的权利，并制作《行政处罚听证告知书》（附件）经领导审核后送达当事人。如当事人要求听证的，应制作《行政处罚听证通知书》（附件）送达当事人，依照《行政处罚法》规定组织听证。听证结束后，根据不同情况作出处理决定。
七、决定和送达
《行政处罚呈批报告》经领导审批后，制作《行政处罚决定书》（附件），在7日内送达当事人或代收人，并要求其在《送达回证》（附件）上签字盖章。
八、执行
处罚决定书生效后，承办人应督促当事人自觉履行处罚决定。当事人对行政处罚决定不服可在规定时效内申请行政复议或提起行政诉讼，对逾期不履行行政处罚决定的，依照《中华人民共和国行政处罚法》第五十一条处理。
九、结案、归档
行政处罚案件结案后，承办人应制作《行政处罚案件结案报告》（附件）报领导审批，并对违规案件材料进行整理装订，交档案管理人员，由其加盖档案归档专用章，做好登记，归档保存。对移送和转办的案件，待承办部门将案件处理结果回复后，做好登记并归档保存。
