第四章 监督检查
第二十八条 旅游行政管理部门应当依法加强对旅行社和外国旅行社常驻机构的监督管理,维护旅游市场秩序。
第二十九条 旅行社应当按受旅游行政管理部门对其服务质量、旅游安全、对外报价、财务帐目、外汇收支等经营情况的监督检查。旅游行政管理部门工作人员执行监督职责时,应当出示证件。
第三十条 旅游行政管理部门对施行社每年进行一次年度检查。旅行社应当按照旅游行政管理部门的规定,提交年检报告书、资产状况表、财务报表以及其他有关文件、材料。
第三十一条 旅游行政管理部门应当加强对质量保证金的财务管理,并按照国家有关规定将质量保证金用于赔偿旅游者的经济损失。任何单位和个人不得挪用质量保证金。
第五章 罚 则
第三十二条 违反本条例第十二条第二款、第十七条第二款规定的,由旅游行政管理部门责令停止非法经营,没收违法所得,并处人民币1万元以上5万元以下的罚款。
第三十三条 违反本条例第十八条第一款、第二十二条、第二十三条第一款、第二十五条、第二十六条第一款规定的,由旅游行政管理部门责令限期改正；有违法所得的,没收违法所得；逾期不改正的,责令停业整顿15天至30天,可以并处人民币5000元以上2万元以下的罚款；情节严重的,还可以吊销《旅行社业务经营许可证》。
第三十四条 违反本条例第十九条、第二十一条第二款规定的,依照《中华人民共和国商标法》、《中华人民共和国反不正当竞争法》的有关规定处罚。
第三十五条 违反本条例第二十七条、第二十九条第一款规定的,由旅游行政管理部门责令限期改正,给予警告；逾期不改正的,责令停业整顿3天至15天,可以并处人民币3000元以上1万元以下的罚款。
第三十六条 旅行社被吊销《旅行社业务经营许可证》的,由工商行政管理部门相应吊销营业执照。
第三十七条 旅游行政管理部门受理本条例第二十四条规定的投诉,经调查情况属实的,应当根据旅游者的实际损失,责令旅行社予以赔偿；旅行社拒不承担或者无力承担赔偿责任时,旅游行政管理部门可以从该旅行社的质量保证金中划拨。
第三十八条 旅游行政管理部门违反本条例规定,有下列情形之一的,对负有直接责任的主管人员和其他直接责任人员依法给予行政处分：
(一) 对符合条件的申请人应当颁发《旅行社业务经营许可证》而不予颁发的。
(二) 对不符合条件的申请人擅自颁发《旅行社业务经营许可证》的。
第三十九条 旅游行政管理部门工作人员玩忽职守、滥用职权、徇私舞弊,构成犯罪的,依法追究弄事责任；尚不构成犯罪的,依法给予行政处分。
第六章 附则
第四十条 本条例自发布之日起施行。1985年5月11日国务院发布的《旅行社管理暂行条例》同时废止。
