上级质监所有权审理下级质监所管辖的案件，也可以把本所管辖的保证金案件交下级质监所审理。下级质监所对它所管辖的保证金赔偿案件，认为需要由上级质监所审理的，可以报请上级质监所审理。
4．旅行社质量保证金案件的审理
(1)赔偿条件。保证金赔偿应当符合下列条件：
①符合保证金赔偿的范围；
②请求人是旅游合法权益直接受到侵害的旅游者或其合法代理人；
③有明确的被投诉旅行社、具体的要求和事实根据。
(2)审理程序。请求人提出赔偿请求书；质监所作出受理或不予受理的决定；能调解的调解，调解不成的作出处理决定；制作处理决定书通知案件双方当事人。
赔偿请求书应当写明下列事项：
①被投诉旅行社的名称、导游姓名；
②请求人的姓名、性别、国籍、职业、年龄及团队名称、地址、电话；
③赔偿请求和根据的事实、理由与证据。
质监所经审查作出受理决定后，应当及时将《旅游投诉受理通知书》送达被投诉的旅行社；该旅行社接到通知后，应在30日内作出书面答复。书面答复应当写明调查核实过程、事实证据、责任及处理意见。质监所应对该书面答复进行复查。
质监所经审查作出不受理的决定，应当在接到赔偿请求书之日起7个工作日内通知请求人不予受理的理由。
被投诉旅行社接到质监所通知书后，可与请求人自行协商解决全H纷，但必须在规定的时间内将有关和解情况报送质监所。
质监所处理赔偿请求案件，能够调解的，应当在查明事实、分清责任的基础上30日内作出调解，促使请求人与被投诉人互相谅解，达成协议。
质监所对调解不成的案件，可以分别作出以下处理：
①属于请求人自身过错，可以决定撤销立案，通知请求人并说明理由。
②属于请求人与被投诉人的共同过错，可以决定由双方各自承担相应的责任。双方各自承担责任的方式，可以由双方当事人自行协商解决，也可由质监所决定。
③属于被投诉旅行社的过错，可以决定由被投诉人承担责任。可以责令被投诉旅行社向请求人赔偿损失。
④属于其他旅游服务单位的过错，可以决定转送有关部门处理。
质监所作出的处理决定应当用《旅行社质量保证金赔偿决定书))通知请求人和被投诉旅行社。
