质量保证金存缴数额降低、旅行社业务经营许可证的颁发、变更和注销的，国务院旅游行政主管部门或者省级旅游行政管理部门应当在作出许可决定或者备案后20个工作日内向社会公告。
旅行社违法经营或者被吊销旅行社业务经营许可证的，由作出行政处罚决定的旅游行政管理部门，在处罚生效后10个工作日内向社会公告。
旅游者对旅行社的投诉信息，由处理投诉的旅游行政管理部门每季度向社会公告。
第四十九条 因下列情形之一，给旅游者的合法权益造成损害的，旅游者有权向县级以上旅游行政管理部门投诉：
（一）旅行社违反《条例》和本实施细则规定的；
（二）旅行社提供的服务，未达到旅游合同约定的服务标准或者档次的；
（三）旅行社破产或者其他原因造成旅游者预交旅游费用损失的。
划拨旅行社质量保证金的决定，应当由旅行社或者其分社所在地处理旅游者投诉的县级以上旅游行政管理部门作出。
第五十条 县级以上旅游行政管理部门，可以在其法定权限内，委托符合法定条件的同级旅游质监执法机构实施监督检查。
第六章 法律责任
第五十一条 违反本实施细则第十二条第三款、第二十三条、第二十六条的规定，擅自引进外商投资、设立服务网点未在规定期限内备案，或者旅行社及其分社、服务网点未悬挂旅行社业务经营许可证、备案登记证明的，由县级以上旅游行政管理部门责令改正，可以处1万元以下的罚款。
第五十二条 违反本实施细则第二十二条第三款、第二十八条的规定，服务网点超出设立社经营范围招徕旅游者、提供旅游咨询服务，或者旅行社的办事处、联络处、代表处等从事旅行社业务经营活动的，由县级以上旅游行政管理部门依照《条例》第四十六条的规定处罚。
第五十三条 违反本实施细则第三十二条的规定，旅行社为接待旅游者选择的交通、住宿、餐饮、景区等企业，不具有合法经营资格或者接待服务能力的，由县级以上旅游行政管理部门责令改正，没收违法所得，处违法所得3倍以下但最高不超过3万元的罚款，没有违法所得的，处1万元以下的罚款。
第五十四条 违反本实施细则第三十三条的规定，要求旅游者必须参加旅行社安排的购物活动、需要旅游者另行付费的旅游项目，或者对同一旅游团队的旅游者提出与其他旅游者不同合同事项的，由县级以上旅游行政管理部门责令改正，处1万元以下的罚款。
第五十五条 违反本实施细则第三十四条第二款的规定，旅行社未将旅游目的地接待旅行社的情况告知旅游者的，由县级以上旅游行政管理部门依照《条例》第五十五条的规定处罚。
第五十六条 违反本实施细则第三十五条第二款的规定，旅行社未经旅游者的同意，将旅游者转交给其他旅行社组织、接待的，由县级以上旅游行政管理部门依照《条例》第五十五条的规定处罚。
第五十七条 违反本实施细则第三十八条第二款的规定，旅行社及其导游人员和领队人员拒绝继续履行合同、提供服务，或者以拒绝继续履行合同、提供服务相威胁的，由县级以上旅游行政管理部门依照《条例》第五十九条的规定处罚。
第五十八条 违反本实施细则第四十四条的规定，未妥善保存各类旅游合同及相关文件、资料，保存期不够两年，或者泄露旅游者个人信息的，由县级以上旅游行政管理部门责令改正，没收违法所得，处违法所得3倍以下但最高不超过3万元的罚款；没有违法所得的，处1万元以下的罚款。
第五十九条 吊销旅行社业务经营许可证的行政处罚，由原许可的省级以上旅游行政管理部门作出。
对旅行社作出停业整顿行政处罚的，旅行社在停业整顿期间，不得招徕旅游者、签订旅游合同；停业整顿期间，不影响已签订的旅游合同的履行。
第七章 附 则
第六十条 本实施细则由国务院旅游行政主管部门负责解释。
第六十一条 本实施细则自2009年5月3日起施行。2001年12月27日国家旅游局公布的《旅行社管理条例实施细则》同时废止。
