（一）非法转让或变相转让许可证；
（二）未经旅游行政管理部门审核批准，擅自设立分支机构；
（三）违反规定设立办事处、联络处和代表处等机构；
（四）改变登记注册地、变更组织形式、名称、法定代表人、营业场所、停业、歇业等事项，未按规定报旅游行政管理部门同意或备案；
（五）委托非旅行社单位和个人代理或变相代理经营旅游业务；
（六）向旅游者介绍和提供含有损害国家利益和民族尊严、含有民族、种族、宗教、性别歧视及含有淫秽、迷信或赌博等内容的旅游项目；
（七）所作旅游广告不标明旅行社名称、许可证号码，委托代理业务广告不注明被代理旅行社的名称。
第六十二条 旅行社有下列行为之一的，由工商、旅游行政管理部门依照《中华人民共和国商标法》和《中华人民共和国反不正当竞争法》等有关法律、法规处罚：
（一）假冒其他旅行社的注册商标、品牌和质量认证标志；
（二）擅自使用其他旅行社的名称；
（三）诋毁其他旅行社的名誉；
（四）向旅游者提供虚假的旅游信息和广告宣传；
（五）以低于正常成本价的价格参与竞销；
（六）其他被工商、旅游行政管理部门认定为扰乱旅游市场秩序的行为。
第六十三条 有下列行为之一的，由旅游行政管理部门责令其停止非法经营，没收其违法所得，并处以人民币１万元以上５万元以下的罚款：
（一）未经旅游行政管理部门审核批准，经营旅游业务的；
（二）外国旅行社常驻机构超越业务范围，经营旅游业务的。
第六十四条 旅行社被吊销许可证的，由作出处理决定的旅游行政管理部门通知工商行政管理部门吊销其营业执照。
第十一章 附则
第六十五条 国家旅游局制定发布的《旅行社质量保证金暂行规定》、《旅行社质量保证金赔偿暂行办法》、《旅行社投保旅行社责任保险规定》、《旅行社经理资格认证管理规定》、《关于外国旅行社在中国设立旅游常驻机构的审批管理办法》、与本《实施细则》共同作为《条例》的实施细则施行。
第六十六条 《条例》发布实施之前已经设立的旅行社，应当按照《条例》、本《实施细则》及有关规定，重新核定经营范围，更换许可证，办理工商变更登记等手续。
第六十七条 本《实施细则》由国家旅游局负责解释。
第六十八条 本《实施细则》自发布之日起施行。１９８８年６月１日由国家旅游局发布的《旅行社管理暂行条例实施办法》、１９９６年１１月２８日由国家旅游局发布的《旅行社管理条例实施细则》同时废止。
